Remix Terms of Use

1. Acceptance of Terms

By accessing or using the Remix application ("the Application"), you expressly acknowledge and agree to be bound by these Application-specific terms ("App Terms") in addition to BrandBeat's general Terms of Use ("General Terms").

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

2. Image Processing and AI Service Description

The Application provides the following services through artificial intelligence technology:

• Image transformation and style transfer capabilities
• Generation of variations based on input images
• Background removal and replacement
• Color manipulation and enhancement
• Element removal and addition

IMPORTANT NOTICE: The Application processes images using AI technology. Results may vary and are provided on an "as is" basis. We make no guarantees regarding the quality, accuracy, or suitability of generated images for any particular purpose.

3. User Representations and Warranties

By using the Application, you represent and warrant that:

• You have all necessary rights, licenses, and permissions to use, modify, and process any images you upload
• Your use of the Application complies with all applicable laws and regulations in your jurisdiction
• You will not upload images containing illegal, offensive, or inappropriate content
• You understand and accept that AI-generated content may be subject to various legal restrictions in different jurisdictions

4. Intellectual Property Rights

CRITICAL INFORMATION REGARDING IMAGE RIGHTS:

• You retain all rights to your original uploaded images
• AI-generated variations are provided under a limited, non-exclusive license for your use
• The Application does not claim ownership of your uploaded content
• You are solely responsible for ensuring your use of generated images complies with applicable copyright laws
• The Application cannot and does not guarantee that generated images are free from third-party intellectual property rights

Screenshot and Reference Image Notice: The use of screenshots, copyrighted images, or third-party content as reference material is entirely at your own risk. You acknowledge that:

• Using copyrighted material without permission may violate applicable laws
• We do not verify the ownership or rights status of uploaded images
• You bear all responsibility for any legal consequences arising from your use of reference materials

5. Usage Guidelines and Restrictions

You agree to the following binding conditions:

• You shall not use the Application to infringe upon any intellectual property rights
• You shall not upload images containing confidential information
• You shall not attempt to reverse engineer the AI system
• You shall not use the Application for generating inappropriate or illegal content

THE APPLICATION IS PROVIDED "AS IS" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND

• We do not guarantee the availability or reliability of the service
• We are not responsible for any consequences arising from your use of generated images
• We do not verify the copyright status or ownership of uploaded images
• We are not liable for any claims arising from your use of reference materials

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF SINGAPORE:

• BRANDBEAT SHALL NOT BE LIABLE FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APPLICATION OR GENERATED IMAGES
• WE ARE NOT RESPONSIBLE FOR ANY COPYRIGHT INFRINGEMENT OR INTELLECTUAL PROPERTY DISPUTES ARISING FROM YOUR USE OF THE SERVICE
• WE SHALL NOT BE LIABLE FOR ANY BUSINESS LOSSES OR DAMAGES RESULTING FROM USE OF GENERATED IMAGES
• YOUR SOLE REMEDY FOR DISSATISFACTION IS TO CEASE USING THE APPLICATION

8. Indemnification

You agree to indemnify and hold harmless BrandBeat from:

• Any claims arising from your use of copyrighted or protected materials
• Any violations of intellectual property rights
• Any misuse of the Application or generated content
• Any claims related to your uploaded images or generated content

9. Compliance with Laws

You are responsible for:

• Complying with all applicable laws regarding AI-generated content in your jurisdiction
• Obtaining necessary permissions for use of reference materials
• Ensuring your use of generated images complies with local regulations
• Understanding and following applicable copyright laws
