Wix Import Terms of Use

By accessing or using the Wix Import application ("the Application"), you expressly acknowledge and agree to be bound by these Application-specific terms ("App Terms") in addition to BrandBeat's general Terms of Use ("General Terms").

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

2. Trademark Disclaimer and Non-Affiliation

IMPORTANT NOTICE REGARDING TRADEMARKS AND AFFILIATION:

• The Application is an independent tool developed by BrandBeat and is NOT affiliated with, endorsed by, or in any way officially connected with Wix.com Ltd. or any of its subsidiaries or affiliates
• The term "Wix" and any associated logos, trademarks, and brand features are the property of Wix.com Ltd. and are used solely for identification and reference purposes
• Our use of any Wix.com Ltd. trademarks does not imply any endorsement, sponsorship, or relationship between BrandBeat and Wix.com Ltd.
• The Application is designed to work with CSV files exported from Wix platforms as a matter of technical compatibility only
• BrandBeat receives no financial incentives or compensation from Wix.com Ltd. for creating or maintaining this Application

If you are a representative of Wix.com Ltd. and have concerns about our use of any Wix-related trademarks, logos, or brand features, please contact us at artificialreply@gmail.com. We will address your concerns and, if requested, remove or modify any disputed content within 24 hours of receiving official verification of your authority to make such a request.

3. Service Description

The Application provides the following services:

• CSV file import and processing capabilities
• Conversion of product data into Canva-compatible formats
• Creation of catalogs, menus, and other design materials
• Integration with Canva's design platform

4. Usage Guidelines and Restrictions

You hereby agree to the following binding conditions of use:

• You shall only upload CSV files that you have the right to use
• You shall not use the Application to infringe upon any intellectual property rights
• You shall not attempt to reverse engineer or compromise the Application
• You shall not use the Application to misrepresent any affiliation with Wix.com Ltd.
• You shall comply with all applicable laws and regulations regarding data import and usage

5. Data Rights and Responsibilities

With respect to imported data and created designs:

• You retain all rights to your original content and imported data
• You are solely responsible for ensuring you have the right to use and import the CSV data
• You grant BrandBeat a limited license to process your data for the purpose of providing the Service
• Generated designs are subject to Canva's terms of service and licensing requirements

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF SINGAPORE:

• THE APPLICATION IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES OF ANY KIND
• BRANDBEAT SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM THE USE OF THE APPLICATION OR ANY IMPORTED DATA
• BRANDBEAT MAKES NO REPRESENTATIONS ABOUT THE ACCURACY OR RELIABILITY OF CSV DATA IMPORTED FROM WIX OR ANY OTHER PLATFORM
• BRANDBEAT IS NOT RESPONSIBLE FOR ANY ISSUES ARISING FROM INCOMPATIBILITY BETWEEN WIX EXPORTS AND THE APPLICATION
• YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE APPLICATION IS TO CEASE USING IT

7. Indemnification

You agree to indemnify and hold harmless BrandBeat, its affiliates, officers, and employees from:

• Any claims arising from your use of the Application
• Any claims related to your imported data or created designs
• Any claims regarding trademark infringement or misrepresentation of affiliation with Wix.com Ltd.
• Any violation of these Terms or applicable laws

8. Changes to Terms

BrandBeat reserves the right to modify these Terms at any time. Continued use of the Application after any such changes constitutes your acceptance of the new Terms.
